Letter of Credit and the UCP The importance of letters of credit to the current commercial society is evidenced by the many rules established to regulate and control its usage. These rules are called the Uniform Customs and Practice of Documentary Credits (UCP), which were created by the International Chamber of Commerce (ICC).5 Several commentators tend to accept this unification, such as Royston Goode, who describes it as â€Å"the most successful harmonizing measure in the history of international commerce†.6 In fact, the first version of these rules was drafted by the ICC in 1929. The rules were revised many times until the last version, UCP 600, was issued in 2007 and came into force on 1 July, 2007.7 Even though the UCP 600 regulates letters of credit, the legal status of these rules will not be considered binding until they are incorporated into the two parties’ contract, as it is mentioned in Article 1 of the UCP 600.8 Letters of credit, which are also known as documentary credit or banker’s commercial credit, is defined in Article 2 of the UCP 600 as â€Å"any arrangement, however named or described, that is irrevocable and thereby constitutes a definite undertaking of the issuing bank to honour a complying presentation†. As the construction industry worldwide is a conspicuous consumer of raw materials of many types and it does not have an enviable record in its attitude to managing the waste, it produced both during construction and as a result of the demolition of buildings. Although there are some demolition materials were recycled, such as doors and windows, or bricks, these components are limited that most of the construction waste has long been indiscriminately loaded into containers and taken to landfill with no attempt to salvage anything that might be of use. However, landfill is not a suitable long-term to handle the solid construction waste, as depleting the worlds natural resources, our pollution may be irreparably damaging its natural eco-system. The practice of solid waste management is underpinned by a hierarchy of waste control measures (Peng et al., 1997). This hierarchy, shown in Figure ##, means control measures are preferable to recycling rather than disposal the waste by incineration or land-filling. Recycling of solid waste means re-used the waste after that waste is re-processed. Therefore, the amount of solid waste of construction industry can be reduced by recycling. To recycle the solid waste, the building materials and components is needed to be re-examined their life cycle by life cycle assessment, that is the framework within which a material or product is examined through its entire from raw material extraction, manufacture, construction, use, maintenance and disposal. As a result, the solid wastes were used to be handled in one direction that is using for landfill, but now some of the solid wastes can be used for another construction works, so that the waste can be reduced. Nevertheless, in order to achieve the goal, all participants in the construction process are needed to make the integrated effort. If someone is going to demolition a building and want to recycle the construction waste, there should be another construction project that is going to use the recycled material. Effective waste management therefore requires a collaborative effort through the construction supply chain in which the client, designer, materials manufacturers and suppliers, construction and demolition contractors and waste disposal contractors all have an important role to play. Also, innovative design can have a significant impact on material wastage. A better waste management can also be promoted by innovative supply arrangements. From some adopting practices like taking-back surplus or recyclable materials (Environment Australia, 2000), it is reported that some producers of construction materials now are starting to take responsibility for the whole life cycle of their products. An example is showing that Interface Australia Pty Ltd has refocused its supply arrangements to achieve less wasteful practices. The company of supplying modular carpet tiles has adopted a system throug h which customers lease rather than buy the carpet. Customers pay a monthly fee, which includes warranty, design, manufacture, installation, maintenance and final reclamation of the product, for the value and use of the carpet supplied. Construction Construction Contractor can also reduce solid waste during construction, as their works may include waste management plans, good site management and organization. Accurate estimating and ordering with nil allowance for waste reduces the volume of waste, the cost of materials and the cost of waste disposal. On the construction site, it should be clearly separated and labeled the wastes which can recycle and cannot recycle. It is reported that through its waste minimization measures, Fletcher Construction reduced waste disposal costs by 55% and increased profits compared to another project, of very similar design and construction, in which waste minimization measures were not implemented (McDonald, 1996). The company operates a 2.2 acre (0.89 ha) warehouse, employs 16 people and reported expected gross sales of US$1,000,000 in 1992 (Hazen and Sawyer PC, 1993). At present, such exchanges are in their infancy in Australia although some government agencies have created exchange web sites. However, in some situation that salvage and re-use are not possible, due for instance to the use of composite materials, demolition waste can still be recycled. Since then other studies by Heino (1994), Soibelman et al. (1994), Guthrie and Mallett (1995), Lingard et al. (2000) and Teo (2000) have reinforced this view. Due to time and cost constraints, poor leadership and a lack of experience in dealing with environmental issues, their findings suggest that negative attitudes towards waste management prevail on construction projects. to the construction industry of making itself more sustainable, it would seem that the challenge is more fundamental than merely creating policies and systems to monitor work-practices. Rather, the problem is cultural and lies in changing peoples attitudes to issues such as waste management.

Effective Literacy Strategies for English Language Learners Essay

Introduction English Language Learners (hereafter referred to as ELLs) currently comprise 10% of the total school population in the United States (National Center for Education Statistics, 2005). It is a population that is going to continue to increase in American public education and their specific needs for learning literacy are of great importance to teachers. Since schools and teachers are increasingly judged based upon the academic achievement of students, then the success of the growing population of ELLs is going to be increasingly important. In the present paper the role of the teacher and specific research-based literacy strategies for ELLs is investigated. Teacher’s role In a research article by Yoon (2007), the question of the teacher’s pedagogical approach in relation to ELLs participation in the classroom was investigated. Three teachers with varying approaches to teaching ELLs were observed. The first teacher believed that teaching ELLs was not his â€Å"full responsibility† and to talk or not was the students choice and the teacher respected it. Also many of the discussions were based on American cultural topics. This teacher reported that the ELLs in his classroom were â€Å"shy and quiet.† The ELLs in this classroom reported being â€Å"frustrated† and often did partner work with special education or other non-mainstream peers. The second teacher modeled through her teaching how to position ELLs as important members of her learning community. She believed teaching ELLs was her responsibility and she tried many strategies to meet the diverse needs of her learners. She attempted to embrace her studentsâ€℠¢ cultural differences by asking them questions about their native culture. Reflection of Educational Philosophy

More than ever, teachers have myriad of decisions to make in their classrooms. Naturally, they have to determine curricula, how to rate the students on their work and the specific grades to give to each pupil. However, a teacher's responsibility goes far beyond this. They must decide what other skills would be helpful, or even essential, to live in this fast-paced global environment. Beyond the academics, students need education in intercommunication, diversity and multiculturalism, time management, critical thinking, creativity and expression, and multi-tasking. Many students also need self-esteem building, stress reduction methods, psychological support and just a caring, nonjudgmental hand of support. According to the class readings, educational philosophy reflects the personal values/principles that guide teachers in making choices in their classroom. To determine these choices, they should take into consideration the nature of reality (metaphysics); the study of knowledge that has been disclosed to man by God (revealed); knowledge that is confirmed trough the senses (empirical); knowledge that is accepted as true because it comes form noted experts in their respective fields (authoritative); knowledge that comes from within (intuitive); the study of objective or subjective values; permanent and unchanging values (absoluteness of values) as well the hierarchy of values. My hope is that I will have a broad educational philosophy based on my personal and religious values that guides me in the long run, but, at the same time, the ability to see each child as an individual who has his/her unique needs. Each student exists in a different reality of circumstances, is surrounded by and reacts to different sensual stimulation, learns accepted knowledge at a varied pace and aptitude, and has a special mindset and internal belief system. A teacher should not compare students based on their talents or abilities-each child is special in his/her own way. The pupil's strengths should be encouraged and their challenges improved. I believe that the students of today must learn their academics. That goes without saying. However, above all else it is essential to instill within them respect for others and themselves, the ability to manage change, and the patience to accept temporary setbacks. As they get older, their life decisions will become increasingly difficult. With a strong foundation of self-worth and the ability to respect the differences and needs of others, it is hoped that they can make the decisions that are best for them and their world at large.

Future Concerns †Gattaca and Fahrenheit 451 Essay

Popular fictions texts expressing views of the future educate audiences about current issues and the dystopias that develop from them. Texts such as the film ‘Gattaca’, directed by Andrew Niccol and novel ‘Fahrenheit 451’ by Ray Bradbury explore futuristic societies and the implications that become of their innovation. Although entertaining, texts such as these are didactic and must be taken seriously, as they communicate messages to audiences regarding prevalent concerns and possible futures based on society’s choices. Gattaca’ (1995) directed by Andrew Niccol, follows the story of the underdog Vincent, who is challenged by genetic discrimination against ‘in? valids’ like himself. Through an elaborate identity switch and the help of ‘genetically advantaged’ Jerome, Vincent prevails to achieve his dreams and find his place at Gattaca Space Station. Niccol utilises conventions of film to convey messages to the audience by highlighting issues relevant to the context of production. Gattaca’ incorporates many themes which highlight the corruption and inequality in this strange, new world. Niccol explores concepts such as elitism, perfection, inequity and modernism. This film opens with two contrasting epigraphs, which entices viewers’ interest into moral themes in ‘Gattaca’. The first quote reads: â€Å"Consider God’s handiwork; Who can straighten what He hath made crooked? † Ecclesiastes 7. 13. An interpretation of this quote is that life is intended to be left alone to take its course, which is contradictory to many ideas in ‘Gattaca’. The quote following reads: â€Å"I not only think that we will tamper with Mother Nature, I think Mother wants us to. † Willard Gaylin. This presents audiences with differing opinions to contemplate as they consider what scientific advancements their own future holds, watching Vincent in his. The opening scene is an extreme close up shot of Vincent’s fingernails, hair follicles and loose skin, against a blue cubicle. The extreme close up shot suggests importance as the camera focuses in on the subject matter, emphasising the significance of Vincent’s DNA. Sterility and cleanliness is suggested by the use of cold, deep blue hues. The use of blue is constant throughout the film, as is the significance in detail. These concepts tie to other scenes, such as ‘The Eyelash’, where Vincent’s own ‘invalid’ eyelash is discovered during a murder investigation. This concept highlights the precision of technology in the future, and that life with such structure becomes complicated. Audiences can learn lessons from examples such as these scenes s they can relate the situations Vincent is put in with possible futures based on the direction society is heading in present times. Another effective technique demonstrated by Niccol is the first person narration by the central character, Vincent. This is important for the development in the movie, as Vincent is the protagonist we are encouraged to empathise with. Therefore, the use of bias narration and perspective is effective in supporting the ideas presented in the film. Following the opening scene is ‘The Not Too Distant Future’, which cuts to a low angle shot looking up to the bold, symmetrical lines of the building. In this shot, Gattaca is shaded in black and grey tones, also indicating the power and formality of the institution. As the camera tilts down, the strong lines and colouring remain constant as view of the staff are also brought into the frame. Directors have dressed actors in blue business suits, again, enforcing the concept of formality, conformity and sterility. The uniformed staff are very bland and indistinguishable from one another in their uniformed clothing. Silence is broken by the rising volume of diagetic sound effects, such as the beeping sound of accepted ‘valids’ through the turnstile, as well as an anonymous greeting by a placid female voice: â€Å"Welcome to Gattaca†. These techniques develop the idea that society has become lifeless and ‘black and white’, as Gattaca presents characters as clinical and robotic products of genetic modification, teaching audiences about social issues that relate to futures.

The Civil War, which took place from the 1945-1949, was a devastating war between the Nationalists, who were led by Chiang Kai-Shek and the Communists who had many great leaders. For example, Mao Zedong who helped establish the Communist capitol o f Shih-Chia -Chuang which was a huge railroad center and ChenYi and Liu Bocheng who helped cut the Nationalists by destroying the protected outposts along the Lung-Hai and the Ping-Han lines which led to many other isolated cities. The roots of the conflict between the Communists and the Nationalists go back all the way to the 1920s. Their basic differences were over the formal agreement to cooperate in the war against Japan. In the end the Communists were victorious by gaining the peoples enthusiastic supports. Chang resigned and fled to Taiwan which was the only territory the Red Army did not occupy. The Civil War involved the Nationalists and the Communists in a dispute over land and who would rule China. An Explanation of the Use of Imagery and Figurative Language to Convey the Central Theme in Mending Wall, a Poem by Robert Frost In the poem â€Å"Mending Wall†, Robert Frost uses language and paragraph structure in order to develop controversial ideas about the necessity of change and stirring rebellion, and about maintaining individuality. One of the prevalent themes present in this poem is that of change, and when it is necessary. When describing the uselessness of the wall, the speaker says, â€Å"My apple trees will never get across/ And eat the cones under his pines†. Here, the speaker emphasizes that the wall is not needed, and implies that there is no use in mending the wall, therefore advocating for change. The speaker’s believes that the wall is not necessary, shown when he says, â€Å"There where it is we do not need the wall† (line 17). He clearly sees no use for the wall anymore and is thinking practically. Logically, maintaining the wall is simply a waste of time and resources, as it is no longer needed. Frost relays the theme of change and rebellion through the speaker’s questioning of old customs as time goes on. After the speaker suggests that they perhaps break down the wall the reaction he receives is, â€Å"He only says, ‘Good fences make good neighbors’ †Å"(line 27). The neighbor’s repetition and insistence of this proverb shows his devotion to tradition and his unwillingness to change. This proverb has most likely been passed down over generations, once again reinforcing the idea that the neighbor is obsessed with custom and tradition. The fact that the poem ends with this line suggests that no change was established, and that the wall remained. The young, refreshing voice of change is clearly overshadowed by the elder opinion that change is unnecessary if the current system is working. This is an extremely powerful and controversial message, which is especially interesting during a time of such political uproar in America. Another message clear in Frost’s poem is that of the importance of individuality. For example, in lines 8 and 9, the speaker says, â€Å"And on a day we meet to walk the line/ And set the wall between us once again†. The order of these lines is meant to express the irony of the situation. The only time the two neighbors converse or meet is when they are trying to ensure that they won’t be bothered by each other for the rest of the year. This exposes the American culture as an individualistic one, and subtly criticizes the American belief in autonomy. In addition, when describing the mending of the wall, the speaker says, â€Å"One on a side† (line 16). This emphasizes the fact that even when working together towards a common goal, the two are separated. However one of the French commanders Jumonville was killed by Tanacharison or one of his tribe in this attack, and the French lost no time in blaming Washington and capturing him and his party of followers. However, he was later allowed to go with his troops back to Virginia. Historians contend that this nevertheless showed Washington’s bravery, impetuousness, and initiative. The final impact of this episode was that it fueled tensions between both the French and British military powers and led to the Seven Years War (1754-1758). In 1755 Washington was appointed senior aide to the British General Braddock on the expedition to reclaim Ohio county and other territories. However, they were ambushed by the French and some Indian allies and had to retreat. Washington on this occasion had to assume overall command after Braddock was mortally wounded at the Battle of Monongahela, and dutifully led an orderly retreat. His exemplary command ev en in the face of defeat led Governor Dinwiddle to promote Washington to the rank of Colonel in the Virginia regiment and Commander of all forces raised by the British in defense of the colonies. Washington was thus given command of the first full-time American regiment of regular servicemen of 1000 troops. Washington was a strict disciplinarian and a tough commander- he led aggressive campaigns against the Indians that resulted in a loss of a third of his men in 20 battles waged in just 10 months. Nevertheless, his campaigns meant that Virginia could relax in relative comfort compared to the other counties. Cultural Assimilation Essay With globalization and people’s living quality advancing dramatically, every year, American universities welcome tens of thousands of international students from all over the world. The land of freedom and justice has opened its doors to those who seek new options and better opportunities and sometimes it asks for certain changes and adjustments fir those who come to study aboard. When these international students pursues higher education in US, fulfilling their life experience and learning something new from American culture, they too bring with them elements of international experience to an American university. Taking up a considerable portion of student population in the university, international students face difficulties to assimilate with local students, particularly in terms of linguistic and cultural differences. International student struggles to become one with the world around him. Some popular cultural studies experts believed it is best for students from all over the world who come to the United States and lose their cultural identity and â€Å"melt† into or assimilate into the American culture. Assimilation occurs in many different ways in our universities, and it is unfortunately, a part of life that we all international students have to learn to accept, no matter the consequences. According to various critics, the process of assimilation occurs in two distinct forms: Language and Culture. My paper will demonstrate the distinction between these two types of assimilation, arguing that language assimilation is necessary, but cultural assimilation can be problematic or damaging. I, being an international student feel that most important aspect of assimilation that an international student faces is language. In American society, learning to speak English properly is a crucial factor and is a form of assimilation. However, people who have decided to come to America to study have found it rather difficult to assimilate into American society for several reasons. International students are forced into an English – speaking classroom and expected to assimilate to the local language with very little help of the educators. The educators are not be blame, the demand for teachers is extremely high and the teachers we have fill the gaps, whether they share a language with their students or not. Linguistic assimilation is important for international students but they should keep in mind that they should not completely melt in other language, which results in eradication of their cultural language. This situation is perfectly portrayed by Salman Rushdie in his essay â€Å"‘Commonwealth Literature’ doesn’t exist† that discusses the conflicts in India over the English language. Salman Rushdie in his essay â€Å"‘Commonwealth Literature’ doesn’t exist† discusses the conflicts in India over the English language. Some in India see English as the language of British imperialism and believe that it shouldn’t be used. Others disagree because the language that is proposed to replace English in everyday use is Hindi, which has strong connections to religion, which are not universally accepted. He sums up his position by saying, â€Å"†¦it is completely fallacious to suppose that that there is such a thing as a pure, unalloyed tradition from which to draw† (pp. 2541). Rushdie believes that language is an essential part of expr essing culture. He explains that, though Indian and British literature are written in English but they are distinct from one another and that just because they share a common language doesn’t diminish the value of the Indian culture. Rushdie acknowledges the growing importance of global trade and that English is well suited to serve as its communication medium. There is essential technical and scientific vocabulary that is used regularly in international exchanges that have no analog in local languages, such as Hindi. He believes that India needs to continue to embrace English, in order to remain competitive in the global community. Rushdie’s idea of embracing language that is common in the society perfectly exemplifies that international students should embrace a common language which is common in the university in order to stay in competition with home students and communicate their ideas. I have personally experience this situation in my university. So, in order to express thoughts, we (international students) will have to learn a common medium of communication. But learning a different mode of communication should not result into extinction of their cultural language. Rushdie tries to portray that international students should not completely evaporate into the new language and forget about their own mother tongue. We should assimilate into new language but should always respect their cultural language more then other Languages, as according to him â€Å"language is an essential part of expressing culture†. Linguistic assimilation as Rushdie shows often comes from coercion and force from outside, but can be necessary for simple survival. This argument is perfectly exemplified by Ngugi Wa Thiong’o in his essay â€Å"Decolonizing the mind† (1986) who tells us of when he was a grade school student in Kenya. The British declared marshal law over the country in the middle of the last century and in an attempt to curb the rebellion and insurgency, they decreed that English was to the sole language spoken. Suddenly Ngugi had to learn English and couldn’t speak the language of his people at school. These experiences shaped Ngugi opinions about the role that language fills. He is of the opinion that language serves two distinct purposes. One is for communication (Pg. 3). He gives the example of how the different cultures in eastern Africa use Swahili to communication with among each other but use their own language when communicating among their own kind. The other role it fills is that of a medium to express ones culture. Different culture tailors different language to convey and pass down its traditions (Pg. 4). Ngugi argument about Language serves two distinct purposes is true for International students as they use â€Å"English† language as a common medium of communication whereas use their â€Å"mother tongue† as a medium of expressing their culture. â€Å"What a common language does for one person, it does for all society†, this is perfectly illuminated in an article from international journal on Minority and group rights. According to article, â€Å"Effective participation in politics as well as the market economy requires t he development of common vernacular expressions, the free flow of information, and established codes of communication. All of these exchanges are enhanced when individuals speak the same language†. The critic of the article, Chih-Yu Shih says that if fixed proportion of population does not speak the common language, the reach of the state and the market will, in turn, shrink. This is both because communication from one language to another can translate into different meanings and because different language structures themselves reflect diverse perspectives proportion of the population cannot speak the national language, the reach of the state and the market will, in turn, shrink. After going through the essays of Rushdie’s, Ngugie and Chih-Yu Shih, we could say that language assimilation makes sense but authors like Ada Maria Isasi-Diaz and Richard Rodriguez says that cultural assimilation is also important. They think that cultural assimilation is very important part of linguistic assimilation as â€Å"Language express cultural†. According to them, one’s traditions such as cultural traditions also have an effect on the willingness and on the degree to which one assimilates. Few international students have found that certain customs like social behaviors which may surprise, offend or offend others; eating food which may seem heavy or bland compared have not been accepted in American culture and might even be condemned. A student who has different traditions than Americans may be frowned upon and may be discriminated against because of the difference. I had experienced this situation as I was discriminated in my folklore class by my follow student. After experiencing this, a question came in my mind that why on a practical level it’s useful to assimilate but on an ethical level, it’s questionable? Sacrificing one’s traditions is a problematic concept even if it means that someone could blend into mainstream culture. International students will have to stick to there own cultures and tradition while assimilating. But this is not the case every time! Some students while assimilating forget about his own cultures and traditions and easil y jolt into others cultures. Ada Maria Isasi-Diaz states a similar situation in her essay â€Å"Hispanics in America†. She reveals the social position of the Hispanics in American society. She says that instead of letting Hispanics follow their own culture and traditions, they are forced to follow the lifestyles of Americans. As only an â€Å"American way of life† existed, Hispanics had to follow the same path of that of the white folks, but also were rarely competing with the dominating white race. Though the Hispanics are the biggest minority group in American society today, their native language and other cultural aspects were scornfully ignored according to Isasi-Diaz, which made assimilation a difficult task for Hispanics. Similarly argument is state by Richard Rodriguez who discusses about culture in America. Rodriguez says, â€Å"I am in favor of assimilation. I am not in favor of assimilation. I recognize assimilation. By making these statements, Rodriguez is saying that he accepts what is happening in regards to culture in America. While he isnt completely for or against what is goin g on, and he isn’t even trying to change it, he is accepting it and working with it. While saying this he doesn’t mean that racial and ethnic distinctions do not matter anymore in America, he thinks that differences are becoming a part of everyday life and they are just so common now that it really isnt such a big deal†. In this essay, Rodriguez states, â€Å"I do think distinctions exist.† Throughout the rest of the essay, Rodriguez goes into great detail of how he understands distinctions exist and how it is changing America. So, this is evident from both the essay that international students will have to blend into America culture in order to compete with American folks in the universities. But blending should not mean that completely giving up their original culture. It means that assimilating into different culture with maintaining the same love for original culture. In conclusion, it is wise to note that both forms of assimilation is adopted by international assimilation in some or the other way. Few international students have over years adopted their â€Å"host† culture’s language, while maintaining their own traditions, customs and values. This common form of communication can also present more opportunities for cross-cultural understanding. International students get to learn many things if they can communicate in a common language. In terms of bilingual education: bilingual education provides the opportunity for a student to use the language that they have grown up with in school while learning another. This permits the student to retain and embrace their language and by extension the culture associated with it. As an old Czech proverb states, â€Å"learn a new language and get a new soul†.

Society’s Expectations of a Female’s Body Image Society plays many roles in peoples’ lives. The biggest role that society plays with females is how they should appear. All over the television, movies, and different magazine covers, females come into view as looking very thin and beautiful. People that see these famous females begin to idealize that body image. The male gender also visualizes these famous females and thinks that all females should have this slender appearance. As the year 2000 rolled in, actresses and models’ body weight decreased, and their waiflike bodies became more noticeable in the public’s eyes. Many little girls grow up idealizing the people in the public eye, giving them the idea that they must look a certain way, which is not a healthy way. These little girls grow up to become teenagers and then discover adulthood. The image that they grew up visualizing only worsens when they hit puberty and their bodies go through drastic changes, which makes them realize their bodies do not look like the people they grew up bearing in mind. When females realize they will not be able to accomplish the same body that the famous acquire, they become very self-conscious and some even develop eating disorders. The media’s role in self-images has greatly affected the way people perceive themselves in today’s society.
